Aboubacar Fall Designated UNCITRAL Guide Representative for Senegal

Dr Aboubacar Fall of Fall & Partners Law Offices, was recently designated as Official Contributor to the UNCITRAL Guide on the 1958 New York Convention for the Recognition and Enforcement of Foreign Arbitral Awards for Senegal.  Senegal ratified the New York Convention on 17 October 1994.

Dr Fall was invited by UNCITRAL to attend the celebration of the 60th anniversary of the 1958 New York Convention, which took place on 28 June 2018 at the United Nations Headquarters in New York.  At this event, the UNCITRAL Guide on the New York Convention as well as a dedicated website to the Guide was launched. 

The Guide was prepared by Prof. Emmanuel Gaillard of Shearman & Sterling LLP and Prof. George.A. Bermann of Columbia University.  The Guide is designed to facilitate the interpretation of the different provisions of the Convention worldwide.  At the event in June 2018, it was decided that UNCITRAL would designate a person or a group of people in each jurisdiction as an official contributor tasked to collect and post on the Guide website, decisions rendered by their respective courts regarding the application of the New York Convention. 

Dr Fall has since provided the UNCITRAL Guide team with the first decision (CONAGRA International S.A. c. Sénégalaise de Distribution de Matériel Avicole SEDIMA) handed down in 1997 by the Tribunal Regional of Dakar regarding the application in Senegal of the 1958 New York Convention to an award delivered by the London based Grain & Feed Trade Association (GAFTA).

Last week, Dr Fall has provided three (3) recent decisions rendered by the Tribunal de Grande Instance de Dakar (2016), the Dakar Court of Appeal (2017) and the Cour de Cassation (2018) on the case of Société Ascot S.A vs. Etablissements Bocar Samba DIEYE applying the 1958 New York Convention.
